1. Acceptance of Terms
By accessing the Service, creating an account, enrolling in a cohort, or using any AI-powered feature, you acknowledge that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not access or use the Service.
These Terms form a legally binding contract between you and the Company. They apply to every visitor, registered user, paying student, teacher, advisor, lead, and any other party interacting with the Service in any capacity.
2. Definitions
"Account" means the credentialed profile you create to access the Service. "User Content" means any text, audio recording, written response, or other material you submit through the Service. "AI Output" means any evaluation, score, feedback, transcript, or generated text produced by the Service's AI tools. "Materials" means all curriculum, exercises, vocabulary lists, audio, video, dashboard layouts, source code, prompts, evaluation rubrics, and any other content made available to you through the Service. "Cohort" means a time-bound enrollment group with a defined start and end date.
3. Eligibility and Account Registration
You must be at least 14 years old to create an Account. Users under the age of majority in their jurisdiction must obtain consent from a parent or legal guardian, who is jointly responsible for compliance with these Terms.
You agree to provide accurate, complete, and current information during registration and to keep it updated. The Service is for individual learners; one Account per natural person. You may not register on behalf of another person, create an Account using a false identity, or maintain more than one Account without our written permission.
4. Account Security and Single-User License
You are solely responsible for safeguarding your password and for all activity that occurs under your Account. You must not share your credentials, transfer your Account, or permit any other person (including family members, friends, classmates, or colleagues) to access the Service through your Account.
Account sharing is a material breach of these Terms. We employ session telemetry, IP and device fingerprinting, and concurrency checks to detect sharing. Detected sharing will result in immediate suspension and may result in termination with forfeiture of fees paid.
If you suspect unauthorized access, notify us immediately at the contact addresses listed in Section 23.
5. The Service
The Service provides a structured English-language learning platform that includes (without limitation) AI-graded writing and speaking exercises, AI-powered chat tutoring, vocabulary spaced repetition, listening and reading exercises, live classes hosted by our instructors, weekly cohort-based curriculum, and progress analytics.
We may modify, add, remove, or suspend any feature of the Service at any time. We will use reasonable efforts to provide advance notice of material changes that adversely affect paid users. Continued use after a change takes effect constitutes acceptance of that change.
6. Fees, Billing, and Auto-Renewal
Some features of the Service require payment. Prices, billing cycles, and accepted payment methods are presented at the point of purchase and are charged in Korean Won (KRW) unless stated otherwise. Payments are processed by our third-party payment provider (Toss Payments). You authorize us and our provider to charge your selected payment method for all applicable fees and taxes.
Where a subscription auto-renews, you will be charged at the start of each renewal period at the then-current rate unless you cancel before that period begins. You are responsible for any taxes applicable to your purchase under Korean or other applicable law.
7. Cancellation and Refunds
Refund eligibility is governed by the specific terms of the program or product you purchased and by applicable consumer protection law in the Republic of Korea, including the Act on the Consumer Protection in Electronic Commerce (전자상거래법) and the Act on the Regulation of Terms and Conditions (약관규제법).
Refund eligibility and amounts are determined by the statutory rules described in our Refund Policy (the 7-day cooling-off period and the Academy Act pro-rata schedule). Refund decisions are made in good faith based on the records contained in the Service.
8. Acceptable Use
You agree to use the Service lawfully, in good faith, and in a manner that respects other users, our staff, and the integrity of the platform. The following conduct is strictly prohibited and constitutes a material breach of these Terms:
- Violating any applicable law or regulation, including but not limited to Korean criminal law, copyright law, and information and communications network law.
- Infringing the intellectual property, privacy, or other rights of any person.
- Posting, submitting, or transmitting content that is unlawful, fraudulent, harassing, defamatory, threatening, hateful, sexually explicit, or otherwise harmful.
- Attempting to obtain access to areas, accounts, or data that you are not authorized to access.
- Impersonating any person or misrepresenting your affiliation with any person or organization.
- Using the Service to develop, train, fine-tune, or evaluate any artificial intelligence model, machine learning system, or competing product.
- Using the Service for any commercial purpose other than your own personal study, including reselling access, tutoring third parties using our Materials, or operating a paid bootcamp built on our content.
9. System Integrity and Security
The following conduct is prohibited and will be treated as an attack on our systems, exposing the offender to civil liability under the Information and Communications Network Act (정보통신망법) and to criminal referral where warranted:
- Probing, scanning, or testing the vulnerability of any part of the Service, or breaching or circumventing any security or authentication measure.
- Reverse engineering, decompiling, disassembling, or otherwise attempting to derive the source code, models, prompts, or training data of any component of the Service.
- Accessing or attempting to access the Service through any automated means (bots, scripts, headless browsers, scrapers, crawlers) other than the published public-facing pages indexed by major search engines.
- Bypassing, disabling, or interfering with any rate limit, paywall, content moderation filter, or access control.
- Introducing malware, viruses, worms, trojans, ransomware, or any other malicious code into the Service or our infrastructure.
- Conducting any denial-of-service, distributed denial-of-service, or volumetric attack against the Service or any of its dependencies (including AI inference endpoints, payment endpoints, authentication endpoints).
- Using stolen, leaked, or otherwise unauthorized credentials to access the Service.
- Performing any security research, penetration testing, or red-team activity against the Service without our prior written consent.
If you believe you have discovered a security vulnerability, do not exploit it. Report it responsibly to security@tieroneenglish.com and allow us reasonable time to remediate before any public disclosure.
10. AI Service Use and Abuse Prevention
Our AI features (including but not limited to AI-graded writing and speaking evaluation, AI chat tutoring, and AI-generated audio) operate on metered, paid third-party infrastructure. Misuse imposes direct financial harm on the Company and is prohibited:
- You may use AI features only for their intended educational purpose, in connection with your active enrollment.
- You must not attempt prompt injection, jailbreaking, or any technique designed to bypass the safety, scope, or content rules enforced by our AI tools.
- You must not attempt to extract, reproduce, or reconstruct our system prompts, evaluation rubrics, or model configurations.
- You must not submit prompts or content designed to cause the AI to generate illegal content, malware, weaponizable information, sexual content involving minors, or content intended to defame, harass, or threaten any person.
- You must not use the AI features to perform tasks unrelated to English-language learning, including but not limited to generating code, performing legal or medical analysis, writing essays for other examinations, or completing third-party assignments.
- You must not attempt to overwhelm, exhaust, or financially attack our AI inference endpoints by submitting excessively large payloads, abnormally frequent requests, or programmatically generated traffic. We enforce per-user rate limits and reserve the right to apply additional limits at any time.
- You must not use the AI features to mass-generate content for redistribution, training datasets, public benchmarks, or any third-party product or service.
- You must not share AI Output with any third party in a manner that suggests it was produced by a different system or that conceals its origin.
We log all AI requests and responses for security, billing, abuse prevention, and quality improvement purposes. Suspicious or excessive activity is automatically flagged for human review. Confirmed abuse will result in immediate account suspension, termination, and where applicable, claims for direct damages equal to the unrecoverable infrastructure costs caused by the abuse, plus the costs of investigation and enforcement.
11. Content Moderation, Logging, and Reporting
All User Content submitted through the Service, including AI chat messages, written exercises, and recorded audio, is logged and stored. We operate automated content moderation across these channels and may also conduct manual human review.
Content that is flagged as illegal, abusive, threatening, or otherwise indicative of harm to the user or to others (including but not limited to content suggesting self-harm, child sexual abuse material, credible threats of violence, fraud, or stalking) will be escalated for immediate manual review. Where required by law or where we judge it reasonably necessary to protect any person, we will report the content and the user's identifying information to the appropriate authorities of the Republic of Korea, including the Korean National Police Agency Cyber Bureau, the Korea Communications Commission, and the Korea Internet and Security Agency (KISA).
We may preserve evidence (including session logs, IP addresses, device identifiers, content, and timestamps) and produce it in response to a valid legal process, lawful government request, or where we judge production reasonably necessary to protect our rights, our users, or the public.
12. Intellectual Property
All Materials are the exclusive property of the Company or our licensors and are protected by the Korean Copyright Act (저작권법), the Trademark Act, applicable international copyright treaties, and other intellectual property laws. This includes (without limitation) the curriculum, exercise content, vocabulary databases, story chapters, bridge texts, audio recordings, video lessons, evaluation rubrics, AI prompts and prompt templates, the dashboard user interface, source code, branding, logos, and the look and feel of the Service.
Subject to your compliance with these Terms and your payment of all applicable fees, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Materials solely for your own personal, non-commercial study during the term of your enrollment. No other rights are granted, expressly or by implication.
13. Confidentiality and Anti-Sharing
The Materials and the dashboard environment are confidential and proprietary. The following actions are strictly prohibited and constitute infringement of our copyright and breach of these Terms, exposing you to liability under the Korean Copyright Act and to civil claims by the Company:
- Recording the Service via screen capture, screen recording, video recording of your monitor, or any analogous means, except for ephemeral personal study notes that are not retained, redistributed, or published.
- Taking screenshots of dashboard content, exercise content, AI Output, or live class sessions for the purpose of redistribution, public posting, or sharing outside your personal study.
- Republishing, posting, uploading, or distributing any Materials on social media, blogs, video platforms, file-sharing services, messaging apps, or any other public or semi-public channel.
- Sharing Materials with any person who is not currently an enrolled user, including (without limitation) classmates outside your cohort, family members, friends, or colleagues.
- Using any Materials, in whole or in part, to create derivative works, study guides, problem sets, AI training datasets, fine-tuning datasets, evaluation benchmarks, or competing educational products.
- Attempting to extract or reconstruct our vocabulary lists, exercise banks, audio files, or AI prompts in bulk, whether by manual collection or automated scraping.
- Selling, sublicensing, leasing, lending, or otherwise transferring access to the Materials or to your Account.
Live classes are recorded for our internal training and quality purposes only. You may not record live classes through any means without our prior written consent. Where you participate in a live class, you consent to being recorded by us in that session.
14. Your User Content
You retain ownership of the User Content you submit to the Service. You grant us a worldwide, royalty-free, non-exclusive license to host, store, process, transmit, evaluate, display back to you, and use your User Content for the purposes of operating, maintaining, securing, and improving the Service, including for AI evaluation, content moderation, and aggregate analytics.
We may use de-identified, anonymized, or aggregated derivatives of User Content for product research, quality assurance, and the improvement of our evaluation models and curriculum. We will not sell your User Content to third parties for advertising. You represent and warrant that you own or have all necessary rights to submit any User Content you upload.
15. Privacy and Data Protection
Our collection, use, storage, and disclosure of personal information are governed by our Privacy Policy and by the Personal Information Protection Act (개인정보보호법) of the Republic of Korea. By using the Service, you consent to the practices described in the Privacy Policy.
16. Third-Party Services
The Service relies on third-party providers for payment processing, transactional messaging, audio synthesis, AI inference, file storage, error monitoring, and other functions. Your use of those features is also subject to the terms and privacy policies of the relevant third parties. We are not responsible for the acts or omissions of third-party providers, except as required by law.
17. Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranty of any kind, express or implied, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, secure, or free from viruses or harmful components.
AI Output is generated by statistical models and may contain inaccuracies, omissions, or biases. AI Output is intended as a study aid only and is not a guarantee of any examination outcome, score, or qualification. You should not rely on AI Output as professional advice in any field, including educational, legal, medical, financial, or psychological matters.
Live class instruction, score predictions, and curriculum recommendations are based on our methodology and best efforts. We do not guarantee any specific examination result, band score, university admission, employment outcome, or other achievement.
18. Limitation of Liability
To the maximum extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of data, loss of goodwill, or loss of opportunity, arising out of or in connection with your use of or inability to use the Service.
The Company's total aggregate liability arising out of or relating to the Service, regardless of the form of action (whether in contract, tort, or otherwise), shall not exceed the total amount of fees actually paid by you to the Company during the twelve (12) months immediately preceding the event giving rise to the claim.
19. Indemnification
You agree to defend, indemnify, and hold harmless the Company, its officers, directors, employees, contractors, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any User Content you submit.
20. Enforcement, Sanctions, and Termination
We enforce these Terms proportionately. Depending on the severity, frequency, and intent of the violation, we may apply one or more of the following sanctions, in any order, with or without prior notice:
- Written warning and required acknowledgment of these Terms.
- Temporary suspension of access to specific features (for example, the AI chat or AI evaluation endpoints).
- Temporary suspension of the Account.
- Permanent termination of the Account, with forfeiture of all fees paid and loss of access to all Materials.
- Civil action for damages, including direct damages, restitution of unjust enrichment, and statutory damages under the Korean Copyright Act.
- Referral to law enforcement authorities of the Republic of Korea where the conduct may constitute a criminal offense, including (without limitation) offenses under the Criminal Act (형법), the Information and Communications Network Act (정보통신망법), the Act on Promotion of Information and Communications Network Utilization and Information Protection (정보통신망 이용촉진 및 정보보호 등에 관한 법률), or the Copyright Act (저작권법).
Termination does not relieve you of obligations accrued before termination, including payment obligations and indemnification obligations. Sections that by their nature should survive termination (including Sections 12, 13, 14, 17, 18, 19, 21, and 22) shall so survive.
21. Modifications to These Terms
We may amend these Terms from time to time. For material changes that adversely affect users, we will provide notice at least seven (7) days before the effective date through the Service or by email, in accordance with the Act on the Regulation of Terms and Conditions (약관규제법). Non-material changes (for example, clarifications, typographical corrections, or updates to legal references) take effect upon posting.
Your continued use of the Service after the effective date constitutes acceptance of the amended Terms. If you do not agree to the amended Terms, you must stop using the Service before the effective date.
22. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of laws principles.
Before initiating formal proceedings, you agree to first contact us in writing and to attempt to resolve the dispute in good faith for a period of at least thirty (30) days. If the dispute cannot be resolved within that period, exclusive jurisdiction and venue for any action arising out of or relating to these Terms or the Service shall lie with the Seoul Central District Court (서울중앙지방법원) of the Republic of Korea, unless otherwise required by mandatory consumer protection law.
23. Miscellaneous and Contact
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of our right to do so later. These Terms, together with the Privacy Policy and any program-specific terms presented at purchase, constitute the entire agreement between you and the Company regarding the Service.
